Kate's Cabin - the small print....
Booking Terms and Conditions for short-term holiday rental agreement - please read carefully, these Terms and Conditions shall be deemed to have been accepted by the Client when making a reservation and when the deposit or full payment for the holiday is accepted and the Booking is confirmed by the Owner.
The booking agreement shall be governed by the laws of England and Wales.
It will be entered into once the Client's booking has been made and the booking has been confirmed by the Owner. The Owner shall have no liability to the Client for any costs, expenses, damages or loss resulting from the booking.
The Client making a reservation agrees that they are authorised to make a booking on behalf of all persons who shall be occupying the property and agrees to take full responsibility for the property and the payment of any rental fees or damages. The lead Client making a reservation must be over 21 years of age.
Rates and Payment
A Booking is only secured on receipt, by the Owner, of a completed 'Booking Form' and a minimum of 30% non-refundable Booking Deposit and the reservation is confirmed by the Owner. If the rental start date is within 8 weeks of the reservation, or there are other applicable circumstances, the full amount is payable. Where a deposit is paid, the Client becomes liable for the balance of the rent and this must be paid at least 8 weeks before the commencement date of the holiday. If the rent remains unpaid, when due, the booking will be cancelled by the Owner, in which case no refund will be possible.
Payment is accepted by paypal, credit card, cheque or bank transfer. There is a 4% additional amount due for payment made by paypal.
The Owner reserves the right to change the advertised rates of the property without notice. The holiday rate will be confirmed at the time of acceptance of the booking and is fixed at that point.
Cancellation
Cancellation by the Client for whatever reason shall be in writing. On receipt of notice of cancellation the Owner will seek to re-let the property for the period of the cancelled booking. If the Owner succeeds in re-letting the property for the whole period it shall refund all monies paid less an administration charge of £30. If the owners only succeed in re-letting the property for part of the period booked they shall refund an amount equal to the monies paid less (1) the rental period which is not re-let and (2) an administrative charge of £30. If the Owner is unable to re-let the property then all monies paid by the client shall be forfeited. We strongly advise our Clients to take out holiday cancellation insurance as they are liable for the whole holiday cost if the booking period cannot be re-let.
If for any reason it proves necessary for the Owner or Owners Agent to make a change in the Client's holiday booking or for the booking to be cancelled then the Owner will use reasonable endeavour to make an alternative booking or failing this will refund to the Client a pro rata amount, not exceeding the amount paid by the Client. The Owner shall be under no further obligation or liability in this respect.
Special Conditions Regarding Severe Weather
In the event of heavy snowfall or other severe weather that affects your ability to arrive on your scheduled arrival day, and you have to cancel, we will be unable to refund your holiday cost as it will be highly unlikely that we will be able to re-let the dates. However, you are welcome to re-schedule your holiday to a later date at the same property. If the rate for the rescheduled dates are higher than the original dates, the difference will be payable. If the rate is lower for the rescheduled dates, we are unable to provide a refund.
Change of Dates
Once a booking has been accepted by the Owner it can only be changed to alternative dates by agreement and confirmation. The dates of the holiday may be changed providing the property is available for the new dates and the Owner agrees to the change. A handling charge of £30 will be payable for any agreed changes to the original booking.
A request to change the booking to another property will constitute a cancellation of the booking and be subject to our Cancellation Policy.
Period of Hire
Rates are per log cabin for the confirmed rental period on a self catering basis. Rates quoted apply only for the specific number of guests and dates shown. Should you change the number of guests or dates then the rates are subject to change.
The rental period commences at 4:00pm on the scheduled day of arrival and terminates at 10:00am on the scheduled day of departure. These times must be respected in order for us to ensure our full service standards. Should a request be made for either an early arrival or a late departure, this may sometimes be possible but will be strictly subject to the Owners agreement and confirmation in writing. An additional charge applies for an early arrival or a late departure.
Provision of Keys
Keys must be collected and returned in accordance with instructions provided.
Use of Property
The booking applies only to the occupants and period listed on the Booking. The maximum occupany at the property is stated in the property information particulars and corresponds to the number of beds provided and MUST NOT be exceeded without our prior consent. In the event the maximum occupancy has been exceeded without prior consent the Owner has the right to revoke the booking without refund and ask all persons to leave the property immediately. Only the persons whose names are detailed on the Booking Form are permitted to stay in the property.
If more than 2 day visitors to the property are expected, this must be agreed in writing with the Owner or Owners Agent and their names provided. No more than 2 day visitors to the property are permitted without prior approval of the Owner.
Day visitors are not permitted to stay overnight at the property.
Bookings will not be accepted from parties of young people, student groups, hen or stag parties without written agreement and we reserve the right to refuse or revoke any bookings from parties which may in our opinion be unsuitable for the property or park.
A cleaning/damage deposit may be requested before acceptance of any booking.
No parties are permitted to be held within the property or park grounds without the Owner's permission.
Parking
Parking of vehicles must be in the designated car parking space and must not obstruct the roadway, your vehicles, their accessories and contents are left entirely at your own risk. The Owner will not be responsible for any loss or damage to any vehicle. Repairs to vehicles must not be carried out at the Cabin.
Care of the Property
The Client is obliged to keep the Cabin and all furnishings, fixtures, fittings and effects in the same state of cleanliness, repair and condition as they were in at the commencement of the holiday and will be responsible for any damage to the holiday property or the furniture, fixtures, fittings and effects and must ensure that the property is left clean and tidy, both inside and outside the property. Anything broken or damaged should forthwith be repaired or replaced with an article of similar type or value to the satisfaction of the owner. If this is not possible any damage or breakage should be reported to the Owner immediately and paid for before departure. In default of such obligation, the Client is obliged to reimburse the owner against any costs incurred by the Owner in remedying such default. The Owner reserves the right to raise invoices for any damage and/or replacements and/or repairs caused during the stay at a later date and legal action will be taken in the event of non payment.
The Client must not assign or part with the possession of the property or any part of it or anything contained in the property or use it other than as a single dwelling for holiday occupation by the people whose names appear on the booking form.
The Client must not be a nuisance or inconvenience to occupiers of neighbouring properties, the Park or adversely affect any insurance of the property.
If it is deemed by us in our reasonable opinion that the behaviour of any member of your party causes, or would be likely to cause, danger, distress, disturbance, offence or upset to a third party or damage to the property and its contents both internally and externally, your holiday will be terminated immediately and the property must be vacated at once, without recourse.
Portable heaters, lighting equipment or any items that may cause danger to the log Cabin are not permitted, inappropriate items such as bicycles, golf equipment, fishing and other bulky items are not to be taken into the Cabin.
The property is a private holiday home and will be presented to the Client at a high standard, and the Owner requires the property to be vacated and left in the same condition.
Damage and good Housekeeping Deposit
The Owner may charge a damage/good housekeeping deposit in which case the Client agrees to pay such a deposit at the request of the Owner. The Owner shall be entitled to deduct from the damage/housekeeping deposit the cost of remedying any breach of the obligations covered in these booking conditions.
Heating and other utilities should be used with care - excess usage, above average usage, will be chargeable to the Client.
Noise and Nuisance
Causing Noise or other Nuisance to the occupants of neighbouring properties or others in the Park is not permitted at any time.
Children and Safety Advice
Clients must accept full responsibility for the safety of any children in their booking party. No assurances can be provided as to the safety or suitability of the property for the Client, the Clients children or pets. Cots, highchairs and other baby equipment may be available upon request for infants but Clients are advised to check the safety of any such items before use and also the circumstances of the environment within which they are to be used. Clients may choose to bring their own travel cot or other children's equipment/facilities with them for the duration of their stay.
Children should be closely supervised at all times, this is particularly important around the vicinity of the lake, the Park roads and the verandah railings.
Right of Access
The Owner or Owners Agent of the property shall be allowed the right of entry to the property at all reasonable times during a Client's stay for the purpose of inspection or to carry out necessary cleaning, repairs or maintenance. However, we will seek to minimise any disruption to our Client's stay.
No Smoking Policy
No smoking is permitted in the Cabin or on the Cabin verandah - if you smoke outside in the Park, all 'ends' must be removed.
In the event of evidence of smoking within the Cabin there will be a minimum charge imposed of £150 to odour clean the Cabin.
Use of Complimentary Toiletries and Cleaning Materials Provided in the Property
Use of these items is at the Clients own risk and no responsibility will be accepted for any adverse reactions to complimentary items. The use of cleaning materials supplied in the property is at the Client's own risk - be vigilent about access by children.
Pets
Pets are only allowed if agreed and confirmed by the Owner in writing. When dog's are accepted, the charge will be £20 per dog per week or short break. Dogs must be fully housetrained and well behaved. If dog's are allowed then they MUST be kept under strict control. Submission of the booking form confirms that no pet will be left at the premises unattended nor be allowed on any furniture or beds (even with covers applied) nor be allowed in any bedrooms. All bedroom doors must be kept closed to prevent access by the pet.
Pets must not be permitted to cause any damage to the property or Park nor bark or cause any other kind of nuisance to neighbours. Pets must be exercised away from the premises. If any soiling occurs around the Cabin or in the Park it must be removed immediately. On departure pet hairs should be removed and any additional cleaning costs incurred by the Owner in order to reinstate the property to the clean condition it was in at the start of the rental period will be charged to the Client.
Park rules and regulations
All occupants of the Cabin are required to comply with the Park rules.
Lost property
A minimum charge of £10.00 is made for the return of lost property found after your departure, Items of lost property can only be held for a maximum of one month after which time they are donated to charity. We cannot be held responsible for items reported lost which cannot be found. The Clients property is at all times the responsibility of the Client.
Website and Advertising Information
The Owner or Owners Agent takes every care to ensure the accuracy, both written and verbal, of the property, the Park and local amenity details. All information on the website, on third-party websites, in printed material and provided in email or verbal communications is given in good faith and is believed to be correct at the time of writing, or otherwise communicated. However we cannot be held responsible for changes beyond our control which may become known after writing. The description of a property shows the amenities that property has but generally does not state what is not in the property. Furthermore, the Owner can not accept liability for happenings outside its reasonable control such as the breakdown of domestic appliances, heating, plumbing, wiring, temporary invasion of pests, interference from neighbouring buildings works, damage resulting from exceptional weather conditions.
Broadband Internet Access
Complimentary WiFi is available whilst using the Park reception and bar area, however there is a charge for WiFi provided by Felmoor Park in the Cabin.
Complaints
The property should be ready and well presented for your arrival, but if there is a genuine problem in respect of the Cabin then this should be reported, on the day of arrival, to enable the Owner to resolve any issues - it is our aim that you enjoy your stay, and we want you to return. Issues which are not reported immediately can not be considered subsequently and not after the end of the rental period, however we do appreciate feedback that will enhance Client stays.
Data Protection Act and Privacy Policy
All personal information supplied will be treated in confidence and will not be disclosed to any third parties except where consent has been received or where required by law. In order to provide a service, this information will be securely held in the data systems of the Owner or Owners Agent.
